Article 1 – Scope of Application
AMC CAPE GRACE operates a maritime and coastal passenger transport service as part of a registered tourist activity declared to the French Maritime Authorities. No physical, sporting or nautical activities are organized, supervised or led by the crew. The company does not provide any teaching, assistance or entertainment related to swimming or recreational water activities.
These General Terms and Conditions of Sale (“GTC”) apply, without restriction or reservation, to all sales concluded by the Seller (AMC CAPE GRACE) with non-professional buyers (“the Client” or “the Clients”), wishing to purchase products or services offered for sale by the Seller on the website www.amccapegrace.com.
The products/services offered for sale on the Website are as follows:
Full-day, half-day, and evening sea excursions aboard maxi catamarans departing from the ports of Saint-Raphaël, Hyères, Nice, Marina Baie des Anges, and Marseille, to explore the most iconic destinations of the Provence-Alpes-Côte d’Azur region, such as: the Lérins Islands off Cannes, the Estérel coastline, Agay Bay, Anthéor, the Île d’Or near Saint-Raphaël, Cap Dramont, the three capes (Cap Camarat, Cap Taillat, Cap Lardier), Pampelonne Bay, the Gulf of Saint-Tropez, Fort de Brégançon, the Giens Peninsula, Porquerolles Island, the Calanques of Marseille, the Frioul Archipelago, the Riou Archipelago, the Côte Bleue, the Nice coastline, Villefranche-sur-Mer, Saint-Jean Cap Ferrat, and Cap d’Antibes.

All details and characteristics of the products and services are presented on the website www.amccapegrace.com. Clients are responsible for reading this information before placing an order online. The choice and purchase of a product or service are the sole responsibility of the Client.
The images used throughout the www.amccapegrace.com website are as accurate as possible but cannot guarantee a perfect match with the actual products and services offered.
These General Terms and Conditions of Sale are available at any time on the website www.amccapegrace.com and shall prevail over any other document.
The Client declares having read and accepted these Terms and Conditions by checking the appropriate box before placing an order through the online process on the website www.amccapegrace.com.
Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions made with the Client.

Article 2 – Prices
The products and services offered are provided at the rates in effect on the website www.amccapegrace.com at the time the order is placed by the Seller. Prices are expressed in euros including all applicable French taxes (TTC – including VAT).
These rates are firm and non-revisable during their period of validity. However, the Seller reserves the right to modify prices at any time based on economic conditions (fuel surcharges, etc.) or changes in applicable taxes (VAT, TPM, port and usage taxes).
Products and services will nonetheless be invoiced to the Client at the rate in effect at the time of order confirmation.
The amount requested from the Client corresponds to the total amount of the purchase.
Article 3 – Online Bookings/Orders
It is the Client’s responsibility to select on the website www.amccapegrace.com the products and services they wish to order, under the following terms:
The Client places their order online via the website www.amccapegrace.com. All contractual information is presented in both French and English. The Client declares that they have read and understood the General Terms and Conditions of Sale prior to placing their order and acknowledges that order validation implies full acceptance of these terms.
To complete the order, the Client must provide personal data to the Seller and fill out an online form accessible from the website www.amccapegrace.com.
The sales contract between the Seller and the Client is deemed concluded when the Client checks the box stating “I have read and accept the General Terms and Conditions of Sale” when confirming the order. Until this final step, the Client will have the opportunity to return to previous pages and correct or modify their order and the information previously entered.
A confirmation email, acknowledging receipt of the order and summarizing all related details, will then be sent to the Client as soon as possible. The Client must therefore provide a valid email address when filling in the fields relating to their identity.
If a product or service ordered by the Client becomes unavailable, the Seller undertakes to inform the Client by email or telephone as soon as the unavailability is known.
The offers for products and services remain valid as long as they are visible on the website and subject to availability. The sale will only be considered final once full payment has been received. It is the Client’s responsibility to verify the accuracy of the order and immediately report or correct any errors.
Any order placed on the website www.amccapegrace.com constitutes the formation of a distance contract between the Client and the Seller.
The Seller reserves the right to cancel or refuse any order from a Client with whom there is an ongoing dispute regarding the payment of a previous order.
Article 4 – Payment Terms
The price is paid through secure payment, under the following terms:

Payment by credit card
The price must be paid in full by the Client on the day the order is placed online.
Payment data is encrypted and securely transmitted using the protocol defined by the approved payment service provider handling transactions on the website www.amccapegrace.com.
Payments made by the Client will only be considered final once the Seller has actually received the amounts due.
Article 5 – Tickets Delivery
Tickets will be sent directly by email.
The electronic ticket will be delivered to the email address provided by the Client in the online order form.
AMC CAPE GRACE cannot be held liable in the event of a missing or incorrect email address provided by the Client.
Article 6 – Terms of Use – Onboard Rules
AMC CAPE GRACE reserves the right to modify, without prior notice, the dates, times, duration or itinerary of its sea excursions (due to weather conditions, technical issues, maintenance, or insufficient attendance).
In the event of a late arrival by a passenger, regardless of the reason, the crew reserves the right to depart without the latecomers. In such cases, no refund or alternative excursion will be offered.
Passengers must keep their electronic ticket and present it during any inspection. They agree, in all cases, to comply with the onboard rules established by the captain and crew.
AMC CAPE GRACE does not allow passengers to bring food or beverages onboard the catamarans during excursions (with the exception of small snacks or food for babies/young children).
AMC CAPE GRACE reserves the right to modify or vary the meals served onboard depending on supply availability.
Persons with reduced mobility are welcome onboard; however, not all vessels have standardized accessibility. Please inform us in advance at the time of booking.
Pregnant women and babies are welcome onboard, unless otherwise advised by a doctor.
Minors must be accompanied by an adult. Children remain under the full responsibility of their parents at all times.
Pets are not allowed onboard.
Generally, shoes are not allowed onboard.
AMC CAPE GRACE is not responsible for any cash, jewelry, or other personal belongings brought by passengers, nor for their theft, loss, or damage caused, for example, by natural boat movement, sea conditions, or other factors.
Bicycles are not allowed onboard. Strollers may be brought onboard.
Article 7 – Anchorage, Swimming, and Paddle Use
During certain excursions, AMC CAPE GRACE may offer a stop at anchor in an authorized area, allowing passengers to enjoy free time onboard.
Passengers may, if they wish, swim freely or use the paddleboards provided free of charge, subject to availability.
These activities are unsupervised, unaccompanied, and not instructed, and are carried out under the sole responsibility of the participants.
No aquatic, physical, or sporting activity is supervised, taught, or led by AMC CAPE GRACE staff.
Life jackets are available onboard and can be requested from the crew at any time. It is strongly recommended that individuals who are not confident swimmers, as well as children, wear them during swimming or paddleboarding.
Minors remain under the sole supervision and responsibility of their parents or accompanying adults throughout the entire cruise, including during anchoring stops and free-time activities.
AMC CAPE GRACE declines all responsibility in the event of any incident, accident, bodily injury, or material damage occurring during swimming or paddle use, as these activities are not part of a supervised service and fall outside the scope of the company’s direct responsibility.
Article 8 – Cancellation Policy – Refunds
Tickets are valid for a specific date. In the event of a no-show at boarding or in case of late arrival, tickets will not be refunded. Lost or stolen tickets cannot be refunded or exchanged.
In the case of insufficient attendance, AMC CAPE GRACE reserves the right to cancel a sea excursion at any time or to postpone it to a later date. The Client will be offered either a new excursion date or a full refund.
- Without the “Meetch cancellation insurance” option:
Tickets are non-refundable.
If the Client cancels for any reason, no refund will be issued.
If a sea excursion is cancelled by AMC CAPE GRACE (due to weather conditions, technical problems, insufficient attendance, or other causes), the excursion will either be rescheduled or fully refunded to the Client.
AMC CAPE GRACE offers the Client the possibility to reschedule their cruise for a later date, within the same season, subject to availability and remaining cruise dates.
Rescheduling is only possible if the Client notifies the company by phone or email at least 72 hours before the scheduled cruise departure.
No booking modifications will be accepted within 72 hours of departure.
- With the “Meetch cancellation insurance” option:
An optional “cancellation insurance” is offered to the Client during the online booking process.
This option, managed by the external provider Meetch, is available at a rate of 9% of the total reservation amount (incl. VAT).
By subscribing to the “cancellation insurance” option, the Client may cancel their booking up until the same day of the scheduled excursion.
A refund will be issued within 48 hours:

70% without justification,
-
100% with valid supporting documentation.
Article 9 - Boarding
Clients are informed that boarding begins 10 minutes before the scheduled departure time of the vessel.
In the event of a no-show or late arrival, regardless of the reason, tickets will not be refunded.
Article 10 - Gift Vouchers
Gift vouchers are available for purchase on the website www.amccapegrace.com.
Each gift voucher includes a unique code and is valid for one year from the date of purchase. After this period, the voucher automatically expires and cannot be exchanged, extended, or refunded.
To use a gift voucher, the Client must enter the unique code during the online booking process or present it in-store when reserving their chosen cruise. The voucher must also be presented on the day of the excursion.
Gift vouchers are non-refundable, non-exchangeable, and non-cancellable, even in the event of non-use or absence on the day of the booked excursion.
In the event of loss or theft, no duplicate will be issued.
If a cruise booked with a gift voucher is cancelled by AMC CAPE GRACE (for example, due to weather conditions or operational reasons), the Client may choose between:

Rescheduling the cruise to a later date, within the original validity period of the voucher; or
-
Requesting an exceptional extension of the voucher’s validity period.
Article 11 – Liability
All passengers aboard AMC CAPE GRACE catamarans must comply with the rules established by the company, as well as with the instructions of the captain and crew.
AMC CAPE GRACE shall not be held liable for any failure by passengers to respect safety instructions.
During anchoring stops, passengers are free to swim or use the paddleboards provided free of charge, subject to onboard availability.
These activities are unsupervised, unaccompanied, and carried out under the sole responsibility of the participants.
Minors remain under the exclusive supervision of their parents or accompanying adults.
AMC CAPE GRACE declines all responsibility in the event of any incident or accident occurring during swimming or the autonomous use of paddleboards.
AMC CAPE GRACE shall not be held liable for the loss, theft, or deterioration of personal belongings brought onboard by passengers, including those due to natural boat movement, weather conditions, or other causes.
AMC CAPE GRACE shall not be held liable for delays or cancellations resulting from adverse weather conditions.
Article 12 – Personal Data
The Client is informed that the collection of personal data is necessary for the sale and delivery of products/services.
This personal data is collected solely for the purpose of fulfilling the sales contract. See our legal notice ici.
Article 13 – Intellectual Property
The content of the website www.amccapegrace.com is the property of the Seller and is protected by French and international laws on intellectual property.
Any full or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.
Article 14 – Applicable Law
These General Terms and Conditions of Sale and the transactions arising from them are governed by and subject to French law.
These GTC are written in French. In the event they are translated into one or more foreign languages, only the French version shall prevail in the event of a dispute.
